Please review the following terms of use (the “user terms”) that govern your use of the Mcdade Club Ties website (“the website”). By using the website you agree to follow and be bound by the user terms. The user terms are intended to constitute the whole agreement. No information or advice given by any other means, such as on the website, by email or telephone call, will be binding.

Shipping & Returns

We aim to make every effort to ensure that all products reach you in perfect condition. 

For standard UK deliveries on all orders we send via 1st Class Royal Mail which will reach you within 1 to 3 working days. A guaranteed Next Working Day delivery service for the UK is available if placed before 12noon that day at a cost of £12.00 and a guaranteed Saturday delivery service for the UK is also available if placed before 12 noon on Fridays at a cost of £25.99.

We ship worldwide and all international carriage charges are displayed at the checkout before entering your payment details. Items may only be returned in their original condition to McDade Club Ties, 8 Rogart Street, Glasgow, G40 2AA within 14 calendar days of receipt of the item(s) for a full refund less any Postage and Packaging costs and/or gifts wrapping costs paid by the customer.

A binding contract is formed once your order has been accepted. You may cancel your order within 7 days of your purchase but a small charge will be incurred due to Paypal and Sage Pay transaction fees. Please note that we cannot cancel custom or rush orders either agreed verbally or in writing wanted for a specific date by the customer. Rush orders include items required by Christmas Day, Easter, Valentine’s Day or any other date specified by the customer and ordered within 28 days of the date required.

Whether items(s) are returned in “original condition” is to be decided solely by McDade Club Ties and this will include any jewellery box(es) If item(s) are returned in a condition with which McDade Club Ties is satisfied but without their jewellery box(es), McDade Club Ties will refund the cost of the item(s) less any gift wrapping or Postage and Packaging costs paid by the customer and less a £5.00 flat fee to cover replacement of the jewellery box(es).

If item(s) are returned without being adequately packaged in their original jewellery box(es) or in any other such way as to make them liable to being damaged in the post, AND McDade Club Ties deems that such damage has occurred, such item(s) will be deemed to have not been returned in their original condition and McDade Club Ties can refuse any refund.

Receipt of the item(s) is deemed to be the date on which Royal Mail or other carrier used says that they delivered the item. Personalized items and pierced earrings or jewellery sets containing pierced earrings are non-returnable.

Delivery Terms and Conditions

We prioritise punctuality and rely on reputable couriers with a proven track record of meeting UK delivery schedules to handle our deliveries. While these delivery companies are highly reliable, on rare occasions, unforeseen circumstances might cause a delay. In situations where your item has been collected in good time but fails to be delivered on the agreed date due to courier service disruptions, we, unfortunately, cannot bear any responsibility for the failed delivery. We are committed to upholding our delivery timelines, but it’s important to note that logistics can be influenced by a myriad of eventualities.

Complaints

In the unlikely event that you should wish to complain about the goods or service we provide, you can do so in writing to the following address: 8, Rogart Street, Bridgeton, Glasgow G40 2AA. However, please do call us and we will endeavour to resolve any problem you may have. The telephone number is 0141 554 0448. This is charged at local rates.

Availability

Prices and availability of items are subject to change without prior notice. If your item is out of stock we will make every effort to contact you as soon as possible using the information you have provided on your order with a suitable solution.

Contract Formation

No contract will be formed between you and McDade Club Ties for the sale of any items until payment is completed. Payment will be deemed complete on either a confirmation email from Xero / PayPal to both you and McDade Club Ties, or at such time as McDade Club Ties indicates via email that your cheque has been cleared by McDade Club Ties’ bank. Any email confirmation as detailed in this section, whether from McDade Club Ties, Xero or PayPal, will be deemed complete and to have been effectively communicated to you at the time the confirmation email is sent, regardless of whether or not the email is received. Any contract can be cancelled by McDade Club Ties at any time at their sole discretion and all monies paid in respect thereof will be refunded.

Customs, Duties And Taxes

All duties, taxes and any other payments whatsoever incurred in relation to the importation of goods from McDade Club Ties to another country will be payable by the purchaser of such goods.

Liability

The use of this website is at your own risk. McDade Club Ties is not liable for any damage or loss whatsoever caused by the Internet or our website or any related information technology. McDade Club Ties does not warrant that the website will be uninterrupted or free from computer viruses or other malicious programs or any other technical difficulties which may cause direct, indirect, consequential, incidental or any other damage to you or any other party.

McDade Club Ties shall not be liable to you or any other party for any loss or damage suffered whatsoever, including direct or indirect loss of profit, except from death or personal injury resulting from our negligence, due directly or indirectly to any use of this website or reliance on it or its contents or any information, advice or otherwise in any way connected with it.

Nothing on this website is warranted, either expressly or impliedly, and nothing therein shall constitute advice and should not be relied upon in any decision-making. This website may include technical, typographical or other errors or omissions and McDade Neckwear will incur no liability arising from these. McDade Club Ties does not warrant the accuracy or reliability of any content, information, product or service provided by this website. Your statutory rights in relation to goods or service purchased through this website are not affected.

McDade Club Ties is not liable for any tariffs, taxes or additional costs levied by that countries customs and excise, as a result of packages being seized for non-payment of taxes.

No liability whatsoever will be incurred by us in respect of any links contained in this website. We do not monitor or endorse any material accessed by means of links from our website and take no responsibility for the websites or material accessible via such links.

Variation

These Terms & Conditions may be changed by McDade Club Ties at any time at its sole discretion. Such changes will be intimated by the changes being posted on the website and you will therefore have been notified. The revised Terms & Conditions will take effect after a period of one week commencing from the time from which they are posted. By using the website thereafter, you will have accepted the varied terms and will be bound by them.

Severability

In the event that any term of these Terms & Conditions is judicially held to be invalid or unenforceable, all of the remaining terms shall remain valid and enforceable.

Inspection And Claims

The Buyer shall procure that a reasonably thorough inspection of the Goods is made upon delivery and in any event before they are resold or otherwise dealt with by or on behalf of the Buyer. Claims in respect of defects or errors in quality, description or correspondence with sample re-assembly discoverable on such an inspection shall be made within 14 days of delivery. 

Claims in respect of latent defects or errors not reasonably discoverable on such an inspection shall be made within three months of delivery.

it shall be the Buyer’s entire responsibility to satisfy itself before the Goods are resold or taken into use, by testing or otherwise that the Goods are suitable for the purposes and/or conditions for which it regimes them.

Variations In Quantity

Every endeavour will be made to deliver the correct quantity ordered but the Company may deliver against any order an excess or deficiency (subject to normal tolerances) of up to 10%  of unit of sale. Normal tolerances shall mean such tolerances as are recognised or defined by any UK Government controlled or appointed body or by any association of UK textile manufacturers as being usual or acceptable in respect of goods of a similar quality and description as the Goods.

Warranties

The Company warrants that the Goods will correspond as to quality and description with the Company’s own specification and will be fit for the purposes and conditions of use for which goods of that description are generally sold by the Company. Except as expressly provided herein, there is no representation, condition, warranty or term (whether in each case express, implied, statutory or otherwise) as to the quality of fitness for any purposes of the Goods or their correspondence in quality with any sample or description.

Commissioned Work

Work individually commissioned or bearing the Buyer’s logo, trademark, trade name or other individualisation not used or taken up by the Buyer cannot be credited or reprocessed by the Company. In the event of cancellation or alteration of the contract or any part of it being requested by the Buyer and the Company accepting the same, the Company will charge the Buyer 100% of the price of the work cancelled or to be substituted on which manufacture has been commenced or completed at the date of receipt of such notice of cancellation or alteration by the Company.

Transport

Where the Company transports the goods, the Buyer shall notify the Company and the Carrier in writing otherwise than on a consignment note or delivery document of any claims for non-delivery of or for loss or damage to the Goods in transit within fifteen days of the date of the invoice in respect of the same and in the case of loss from or damage to or non-delivery of any part of a consignment of the Goods in transit within three working days of the date of delivery. 

If a claim is established, the Company’s liability shall be limited at the Company’s option either to giving a refund of the amount paid for the Goods so lost or damaged or giving reasonable credit or allowance for the same or to replacing them at the agreed point of delivery. 

In the absence of written notifications to the Company and the Carrier as described in this condition, the Goods shall be deemed to have been delivered and accepted by the Buyer complete and in a satisfactory condition.

Set-Off

The Buyer shall not be entitled to set-off any claim against payment of any amounts owing to the Company.

Measurements

All measurements specified by the Buyer for any Goods ordered or commissioned shall only be approximate and accordingly the Buyer will accept all Goods tendered by the Company notwithstanding that the actual measurements of the tendered Goods do not correspond exactly with the Buyer’s specified measurements provided that the Buyer shall be entitled to reject any tendered Goods where the discrepancy between the measurements and the actual measurements of the tendered Goods is greater than 10 per cent and are of unsatisfactory condition.

Where the Buyer has ordered Goods by reference to a sample and has in addition specified certain measurements for the Goods ordered; then in the event of there being a conflict between the measurements of the sample and the specified measurements the Company shall be entitled (in the absence of any prior written notice from the Buyer as to which of the measurements are to take precedence) to tender Goods whose measurements correspond either with the sample or the Buyer’s specified measurements and (subject to the proviso to previous Condition) the Buyer will not in such circumstances be entitled to reject the tendered goods.

Waiver

Any concession, latitude or waiver allowed by either party to the other at any time shall not prevent such party from subsequently exercising its full right under this contract in other respects.

Intellectual Property Rights

McDade Club Ties owns all copyright and related intellectual property rights in and relating to the website unless otherwise agreed or specified. An individual page may be downloaded for private, non-commercial and personal use for the purpose of placing an order with McDade Club Ties or using this website as a shopping resource.

With this exception, no contents of this website (including text, video, audio, audio-visual material, graphics, underlying source code and software) may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without our prior written consent. Such permission can be requested by emailing us at info@mcdadeclubties.co.uk  

All weights and measures are approximate. Images may be enhanced, enlarged or otherwise modified. Descriptions are compiled by reference to information available to us at the time of listing. McDade Club Ties shall incur no liability for inaccuracies in this respect but shall endeavour to refund or replace any item proven within 6 months of purchase by an independent registered gemologist report to be incorrectly described to a significant extent. McDade Club Ties shall be the sole judge of “significant” in this respect.

Cancellation By Customer

(a) An Order accepted by McDade Club Ties of Goods from the normal stock of the Company can be cancelled only and before despatch to the Customer of Goods with the written consent of the Company within 14 days from the date of an Order such consent to be in the Company’s absolute discretion and then only upon payment of reasonable cancellation charges which shall include expenses already incurred and account for commitments made by the Company forfeit of deposit and a reasonable sum by way of compensation for loss of an Order. (b) An Order for Goods which are specially made once accepted by the Company may not be cancelled.

Governing Law

The use of this website and its Terms & Conditions and all contracts will be interpreted, construed and enforced in all respects in accordance with the laws of Scotland, and all parties irrevocably agree to the jurisdiction of the Scottish Courts. McDade Club Ties is a company registered in Scotland, number 371981, whose registered office is 8 Rogart Street, Bridgeton, Glasgow, G40 2AA.

Delivery And Returns

Uk Delivery

For addresses within the UK mainland, we aim to deliver your goods the next day if you order before midday Monday – Friday (excluding bank holidays) but please allow 7 days from receipt of your order. Items are dispatched using Royal Mail, UK Mail therefore someone will need to sign for the package.

If an item is out of stock there may be a delay, in some cases up to 28 days. Please note that during certain times of the year (i.e. Christmas), delivery times will vary. Your credit/debit card will only be charged once the goods are dispatched.

Whilst we will endeavour to ensure that this estimated delivery time is met, we cannot accept any liability for late deliveries which are due to circumstances outside of our control (i.e. postal strike). We are happy to deliver to a work or other chosen address given when placing an order.

The charges for delivery are free UK only. Europe, North America and Rest of the World all goods are sent using Royal Mail postage charges which include tracking. We will always aim to have your items with you the next day (UK only).

General Information

Orders will be sent to the delivery address that you specify when placing your order. We cannot be held responsible if this delivery address is incorrect. We will not be able to accept responsibility for lost or stolen items if at your request they have been left somewhere unsigned. We do prefer however that ALL packages are signed for.

On occasion items may be lost in transit. If this occurs, please contact our customer services department by email at info@mcdadeclubties.co.uk or by telephone on +44 (0141) 554 0448 quoting your order number and full delivery address and we will investigate the issue.

Returns

If you are unhappy with your purchase we will (except in relation to any products purchased at reduced price during any sale) exchange or refund a product within 28 days of receipt, provided it is returned to us in a fully re-saleable condition. This does not affect cancellations or your statutory rights. We will exchange or refund a product purchased at reduced price during any sale within 14 days of receipt, provided it is returned to us in a fully re-saleable condition.

Please complete the Returns Form included with your order and return it with the item. There is no need to contact us prior to returning an item. You will be responsible for the cost of returning the goods to us and will remain responsible for any and all returned goods until they reach our warehouse. We strongly advise that a proof of postage certificate should be obtained when returning any part of your order.

If we find that the product has not been returned to us in a fully re-saleable condition we reserve the right to refuse a refund for the product. We will only refund the delivery charge for sending the product to you if the product is damaged, faulty, or does not match your order.

Products should be returned in their original packaging. Once the returned goods have been received by Customer Services we will review their condition before deciding in accordance with our Returns Policy whether to process the refund.

When processing a refund for returned goods, we will refund by the original method of payment and you will receive an email confirming the refund amount. If we decide not to process any refund you will be contacted by our Customer Services department.
